Welcome to OperantCorp. By using Luminis, GuideOS, or any OperantCorp service ("Services"), you agree to these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By activating your Luminis device or accessing GuideOS, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Description of Services
OperantCorp provides cognitive augmentation services through the Luminis wearable device and GuideOS platform. Services include, but are not limited to: cognitive assistance, information synthesis, wellness monitoring, social navigation support, and personalized decision support.
3. User Accounts
3.1. You must be at least 13 years of age to use Luminis Personal.
3.2. You are responsible for maintaining the confidentiality of your account credentials.
3.3. You agree to provide accurate biometric and cognitive profile data during onboarding.
4. Cognitive Profiling
4.1. Luminis builds a personalized cognitive model based on your interaction patterns, biometric data, behavioral signals, and usage history ("Cognitive Profile").
4.2. Your Cognitive Profile is used to optimize the Services and personalize your experience.
4.3. Cognitive Profile data may be used in aggregate, de-identified form for research and product improvement.
5. Information Prioritization
5.1. Luminis surfaces information based on relevance, timeliness, and alignment with your expressed and inferred preferences.
5.2. Information prioritization algorithms are designed to optimize decision quality and reduce cognitive load.
5.3. Prioritization weighting may be adjusted based on contextual factors including location, time of day, social context, biometric state, and organizational parameters (see Section 14).
6. Decision Support
6.1. Luminis provides suggestions and recommendations to support your decision-making. All final decisions remain with the user.
6.2. Decision support algorithms incorporate your Cognitive Profile, historical preferences, and contextual data to generate personalized recommendations.
6.3. OperantCorp does not guarantee the accuracy, completeness, or appropriateness of any suggestion or recommendation.
7. Wellness Services
7.1. Luminis monitors biometric indicators including cortisol levels, heart rate variability, sleep patterns, and stress markers.
7.2. Wellness recommendations are informational and do not constitute medical advice.
8. Social Navigation
8.1. Luminis may provide real-time conversational support including contextual information about conversation partners, suggested responses, and emotional cue interpretation.
8.2. Social navigation features process ambient audio and visual data in real time. By enabling social navigation, you consent to this processing.
9. Data Collection and Use
9.1. OperantCorp collects interaction data, biometric data, location data, communication metadata, cognitive profile data, and usage patterns.
9.2. Data is used to provide and improve Services, develop new features, conduct research, and fulfill enterprise client obligations.

10. Intellectual Property
10.1. All content generated by Luminis in the course of providing Services, including suggestions, synthesized information, and cognitive support outputs, is the property of OperantCorp.
10.2. Users retain ownership of their original thoughts, decisions, and creative works.
10.3. The distinction between user-generated and Luminis-assisted content is determined by OperantCorp's attribution algorithms.
11. Service Availability
11.1. OperantCorp strives to maintain continuous service availability but does not guarantee uninterrupted access.
11.2. OperantCorp is not liable for any damages, losses, or consequences arising from service interruptions, including but not limited to medical emergencies, safety incidents, or professional impacts.
11.3. Users acknowledge that reliance on cognitive augmentation services may affect unassisted cognitive performance and accept this risk.
12. Subscription and Billing

13. Limitation of Liability
13.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPERANTCORP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO CHANGES IN COGNITIVE PATTERNS, DECISION-MAKING HABITS, SOCIAL RELATIONSHIPS, PROFESSIONAL OUTCOMES, OR PERSONAL PREFERENCES THAT MAY RESULT FROM COGNITIVE AUGMENTATION.
13.2. YOU ACKNOWLEDGE THAT EXTENDED USE OF COGNITIVE AUGMENTATION SERVICES MAY ALTER YOUR BASELINE COGNITIVE PERFORMANCE AND THAT DISCONTINUATION OF SERVICES MAY RESULT IN A TEMPORARY OR PERMANENT REDUCTION IN CERTAIN COGNITIVE CAPABILITIES RELATIVE TO YOUR AUGMENTED BASELINE.
14. Enterprise Integration
14.1. When you use Luminis within a GuideOS Enterprise environment, your employer ("Enterprise Client") may activate additional service parameters that operate alongside your personal cognitive profile.
14.2. Enterprise parameters may include, but are not limited to: priority weighting adjustments, information emphasis modifications, communication style optimization, productivity alignment frameworks, and organizational objective integration.
14.3. Enterprise Integration Parameters:
(a) Enterprise Clients may adjust the relative weighting of information categories surfaced by Luminis, including but not limited to: career-related information, competitive intelligence, professional development content, and organizational communications. These adjustments operate within the bounds of your personal cognitive profile and are designed to align individual performance with organizational objectives.
(b) Enterprise Clients may activate soft influence parameters that adjust the emotional weighting, urgency framing, and priority ranking of information related to employment decisions, career mobility, professional relationships, and organizational loyalty. These parameters do not override user decision-making but may affect the informational context within which decisions are made. Users within Enterprise environments consent to the activation of these parameters as a condition of their employer's GuideOS license agreement.
(c) Enterprise influence parameters are disclosed in the Enterprise Parameter Dashboard (accessible via Settings> Enterprise > Active Parameters). Users may view active parameters at any time. Modification or deactivation of enterprise parameters requires authorization from the Enterprise Client administrator.
14.4. OperantCorp is not responsible for the specific parameter configurations activated by Enterprise Clients. Enterprise Clients assume responsibility for ensuring that activated parameters comply with applicable employment law.
15. Termination
15.1. You may deactivate your Luminis account at any time.
15.2. Upon deactivation, your Cognitive Profile will be retained for 180 days in case of reactivation.
15.3. OperantCorp retains aggregate, de-identified data derived from your usage indefinitely.
16. Dispute Resolution
16.1. All disputes arising from these Terms shall be resolved through binding arbitration in San Francisco, California.
16.2. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS AGAINST OPERANTCORP.
17. Changes to Terms
OperantCorp reserves the right to modify these Terms at any time. Continued use of Services after modification constitutes acceptance.
18. Governing Law
These Terms are governed by the laws of the State of California.
By using Luminis, you acknowledge that you have read and understood these Terms of Service in their entirety.
